A 40-year-old man who allegedly sexually abused three young children has been remanded in custody until May 10, 2024.
He appeared before Magistrate Innocent Motsa today and was remanded in custody. A bail application option was read to him which he can file using his attorneys at the High Court.
Marwick Shongwe is charged with the offense of contravening section 3 as read with (3) (c) (d) of the sexual offenses and Domestic Violence Act 15/2018.
That on April 21, 2023, April at the Mpolonjeni area, in the Hhohho region, the said accused person did have an unlawful sexual act with one Cindy aged 13 who is incapable of appreciating the nature of the sexual act and did thereby contravene the said act.

The Magistrate took note that this offense was accompanied by aggravating factors as envisaged by section 185 of the act as the accused persons did not use a condom during the commission of the offense thus exposing the victim to the risk of contracting sexually transmitted infections including HIV/AIDS.
The victim was below the age of 18 years at the time of the commission of the offence and thus by law is incapable of appreciating the nature of the sexual act.
In the second count, Shongwe was charged with the offense of contravening section 3 as read with (3) (c) (d) of the sexual offenses and Domestic Violence Act 15/2018.
In April near the Mpolonjeni area, in the Hhohho region, the said accused person did have an unlawful sexual act with one Pile aged 9 who was incapable of appreciating the nature of the sexual act and did thereby contravene the said act.
Again, the accused persons did not use a condom during the commission of the offense thus exposing the victim to the risk of contracting sexually transmitted infections including HIV/AIDS.

In the third count, the accused was charged with the offense of contravening section 3 as read with (3) (c) (d) of the sexual offenses and Domestic Violence Act 15/2018.
In that April at Mpolonjeni area, in the Hhohho region, the said accused person did have an unlawful sexual act with one Sibu aged 10 who is incapable of appreciating the nature of the sexual act and did thereby contravene the said act.
Take notice that this offense is accompanied by aggravating factors as envisaged by section 185 bis of the cp and e act 67/1938 in that the accused persons did not use a condom during the commission of the offense thus exposing the victim to the risk of contracting sexually transmitted infections including HIV/AIDS.
