Two siblings decided to battle it out before the Commission of Inquiry of the Master of the High Court over their late mother’s vehicle worth E52,000.

Boycey Magongo made his submissions before the Commission wherein he stated that his sister should have not been appointed as an executor of their mother’s estate.

He stated that his sister Bongiwe once threatened to assault him and reported him to the police for stealing their mother’s vehicle when such was not the case.

Instead, he bought the vehicle from his mother when she wanted to renovate her kitchen.

His sister Bongiwe was present and told the Commission that she had a car breakdown and had to borrow her mother’s car, who told her to ask Boycey because he disappeared with it such that she could no longer go to hospital.

When Bongiwe called Boycey he stated that the car was at the garage being replaced with shocks and other items and was in short of E2,500 for payment, which she said she would pay because she needed to use it.
It turned out that Boycey had pawned the vehicle for a loan.

“I asked our mother about this, and she was beyond baffled as we all were because the vehicle was under her name not Boycey’s.

I then advised her to open a case with the police because what our brother had done was illegal,” she said.

Their mother opened a case that is pending in court restricting the sale of the vehicle which will allow for the estate to be winded up.

According to Bongiwe, when Boycey found out that police officers from Manzini were looking for him, he rushed to Mbabane police station to report that officers from Manzini were harassing him.

When the officers called the Manzini office, they were directed to tell Boycey to report to the Manzini police station or he would be listed as a fugitive.

He immediately reported to Manzini, and he was arrested and charged with the theft of a motor vehicle.

When their mother died on April 25, 2023, Bongiwe had to list all her properties as inventory which consisted of the vehicle only because the homestead is on Swazi Nation Land and cannot be sold.

However, the vehicle was found to have been illegally registered under Boycey, and he said he had bought it from their mother.

Boycey was questioned on why his mother would report him for stealing the vehicle if he had purchased it and when asked to produce receipts, he said his mother never gave him any.

According to Bongiwe, Boycey does not listen to any of his siblings such that they have been to Umphakatsi which also washed its hands on his conduct and the matter has been reported at the Magistrates Court for a peace binding.

The vehicle cannot be sold, and the money distributed until Boycey’s criminal matter has been concluded as it is an exhibit as per the directive from the prosecutor handling the matter.

Therefore, the estate remains unwinded.

Deputy Chairperson of the Commission of Inquiry probing Master of the High Court Judge Mzwandile Fakudze said the siblings are fighting over nothing and should find means to keep the peace.

“This is an estate of E52,000 and you all are grabbing each other’s throats over nothing,” he said.

Fakudze said the siblings should listen to Umphakatsi, stop fighting, and consider that the family homestead is built on Swazi Nation Land and therefore cannot be distributed.

As a result, they should live in harmony for their sake and that of their children.
