Six men sell one homestead three times..

‘How to get away with theft’

This sentiment is highly relatable to the six men that appeared before Principal Magistrate Fikile Nhlabatsi, who sold a homestead three times to different people at altered exorbitant prices.

The accused persons are Themba Gwebu 33, Frank Ndzimandze 35, Gideon Gwebu 68, Hlangabeza Dlamini 62, Oliver Dlamini 63, and Jacob Ndlangamandla.

In the first count, accused1, 2, 1, 2, and 6 are charged with the offence of theft by false pretence, in that, upon or about the month of June 2023,2023, at Mbabane in the Hhohho region, the said accused persons, each or both acting in furtherance of a common purpose,,

unlawfully and with intent to defraud and steal, misrepresented to one Musa Maseko that they were property agents selling a home situated in the in the Manzana area.

They, by means of the said misrepresentation, induced Maseko to incur his actual loss and prejudice to the sum of money amounting to E56,500.00, which was paid to the accused persons.

Whereas when the accused persons made the misrepresentation, they well knew that the said home was not for sale and did not belong to any of them, thereby committing the said offense of theft by false pretence.

The accused persons one and five were charged with the crime of theft by false pretence.

During the month of February 2023 and at or near Mbabane, in the District of Hhohho, the said accused persons, each or both acting in furtherance of common purpose,

unlawfully and with intent to defraud and steal, misrepresented to Simile Malindza that they were property agents selling property, a piece of land situated in Manzana area, Mbabane in the Hhohho Region.

They, by means of the said misrepresentation, induced Simile Malindzisa to incur his actual loss and prejudice to the sum of money amounting to E50,000.00, which was paid to the used persons.

Whereas then the said accused persons made the aforesaid misrepresentation well knowing that the said the piece of land was not for sale and did thereby commit the crime of theft by false pretence.

Meanwhile, accused 1,2, 3, 4, 5 and 6 were charged with the offence of theft by false pretence in that, upon or about the month of October 2022 and at (or near) Mbabane in the Hhohho region, the said accused persons, each or both acting in furtherance of a common purpose, unlawfully and with intent to steal, defraud, and misrepresent one Philile Dlamini.

They posed as property agents selling property, a home situated in the in the Manzana area of Mbabane in the Hhohho Region, and by means of the said misrepresentation, induced Philile Dlamini to incur to incur his actual loss and prejudice to the sum of money amounting to E56,000.00, which was paid to the accused persons.

Whereas when the accused persons made the misrepresentation, they knew well that the said home was not for sale and did not belong to any of them, thereby committing the said offence of theft by false pretence.

The long charge sheet revealed that accused persons three and four are charged with the crime of theft by false pretence.

In that upon or about the month of November 2020 and at or near Mbabane, in the District of Hhohho, the said accused persons, each or both acting in furtherance of a common a common purpose,,

unlawfully and with intent to defraud and steal, misrepresented to Dudu Tsela that they were property agents selling property,

a home situated in the in the Manzana area of Mbabane in the Hhohho Region.
They, by means of the said misrepresentation,

induced Dudu Tsela to incur her actual loss and prejudice to the sum of money amounting to E51,900.00, which was paid to the accused persons.

Whereas when the said accused persons made the aforesaid misrepresentation, they knew that the said home was not for sale and did not belong to them, thereby committing the crime of crime of theft by false pretence.

The sextet was remanded out of custody, and their case was postponed to June 7, 2024.

In the same court, Qiniso Samson Nkambule, a 28-year-old of Mantabeni, Mantabeni, under Chief Mashampu of the Hhohho, is charged with the offense of assault with intent to cause grievous bodily harm.

On October 21, 2023, in the Mantabeni area of the Hhohho Region, the said accused person wrongfully, unlawfully,

and with intent to cause grievous bodily stabbed one Mancoba Dlamini with a knife once on his shoulder on the on the right side and once on the neck just next to the shoulder on the right, thereby committing the crime of assault. He was fined E4,000 for spending five years in prison.

A duo also appeared to be charged with the offenses of housebreaking and theft. Melusi Vilane and Sisekelo Jiyane were remanded back into custody until June 27, 2024.

It was said that on January 23, 2023, at Equinox Restaurant, in the Hhohho region, the said accused persons, each one or both, acted jointly in furtherance of a common purpose and wrongfully, unlawfully,

and intentionally entered the restaurant and stole items valued at E38,685.00, the property of or in the lawful possession of Colile Matsebula, and thus committed the said offense.
