A 54-year-old man allegedly rapes 4-year old

In the world of fiction, rapists are evil, nasty, scruffy-looking men who lurk in the bushes or the shadows of the parking garage. On Monday, although it was a well-composed 54-year-old man.

Thulani Eric Maziya appeared before Principal Magistrate Fikile Nhlabatsi, who remanded him back to custody pending a High Court committal. He is set to appear in court on June 21, 2024.

The accused is charged with the offence of contravening section 3(3) of the sexual offences and Domestic Violence Act of 2018.

That on June 7, 2024, at or near Nkwalini Zone 2 area, in the Hhohho Region, the said accused person did have an unlawful sexual act with one * Sihle aged 4 of Nkwalini Zone 2 area and did thereby contravene the said act.

Take further notice that this offence is accompanied by aggravating factors as envisaged by Section 185 bis of the Criminal Procedure and Evidence Act No: 67/1938 as amended in that the accused person did not use a condom during the commission of the offence.

This, according to the Court, exposed the victim to the risk of contracting sexually transmitted infections, HIV/AIDS.

In the charge sheet, it was further mentioned that the victim was below the age of 18 years at the time of the commission of the offence and, thus, by law, is incapable of appreciating the nature of the sexual act.

Take notice further that in the event of conviction, the offender’s particulars will be included in the national register for sex offenders.

Meanwhile, in another court, under the section of fresh matters, two men were charged with theft.

They were both fined E 1 500 for wrongfully, unlawfully and intentionally stealing beef steak meat valued at E750,00, the property of or in the lawful possession of Noyama Malinga and thus committed the offence.

Bongani Khumalo and his partner, Sipho Mavimbela, committed the offence on June 7, 2024, at Mbabane Mvakwelitje Fresh Meat butchery.

A South African man and Liswati were fined E2000 or face two years imprisonment.

The Accused persons were charged with the offence of contravening Section 11 (1) as read with 14(2)(a) of The Arms and Ammunition Act 24/1964 as amended.

In that upon or about June 9, 2024and at (or near) Ngwenya Border in the Hhohho region, the said accused person,

not being a holder of a valid licence or permit to possess a firearm, did wrongfully and unlawfully possess a firearm without a valid licence or permit and thus contravened the said Act.

In the second count, the accused persons were charged with contravening Section 11 (2) as read with 14(2) (a) of the arms and ammunition act 24/1964.

In that upon or about June 9, 2024, and at or near Ngwenya Border in the Hhohho region, the said accused persons, not being a holder of a valid licence or permit to possess ammunition,

did wrongfully and unlawfully possess 20 live rounds of ammunition without a valid licence or permit and thus contravened the said Act.
