Eswatini National Provident Fund (ENPF) is keeping true to their word by taking to task people who fail to remit their ENPF contributions.
The director of Auto Transmac Brothers was apprehended for non-payment of ENPF contributions for his employees.
Dominic Mulube, the Director of Auto Transmac Brothers (PTY) LTD, faced 15 counts of contravening the Eswatini National Provident Fund (ENPF) order after he failed to pay employee contributions and submit required forms.

Mulube appeared before Manzini Principal Magistrate Florence Msibi, who handed down a six-month prison sentence for each count, totaling 90 months imprisonment, or an option to pay a fine of E7 500.
The businessman was charged jointly with his company and pleaded guilty to all 15 charges of contravening the Eswatini National Provident Fund Order No. 23 of 1974.
According to the charge sheet, in counts one to nine, Mulube and his company acted jointly in furtherance of a common purpose by failing to pay into the fund the statutory contributions in respect of his eligible employees.
From counts 10 to 15, the director is said to have failed to complete and forward to the chief executive officer a return in the form prescribed by the order within the specified period and thus contravened the said Order.
He contravened Regulation 20 (2) and (3) as read with Section 36 (1) (f) of the Swaziland National Provident Fund Order 23 of 1974. The court found him guilty as per his pleas.

Faced with his charges, the director mitigated, maintaining that he had rectified his transgressions by having cleared the company’s balance of E1 800 in statutory contributions for his employees.
He appealed for leniency when passing the sentence.
