A 28-year-old man has been arrested for allegedly raping a 12-year-old girl. He appeared before the court on Monday.
Ntokozo Stambu Shongwe (28) of Phonjwane was arrested and charged with contravening Section 3 (1) as read with Section 3 (3) and (9) (b) of the Sexual Offence and Domestic Violence Act 15 of 2018.

On February 23, Shongwe allegedly unlawfully and intentionally had sexual intercourse with the minor without consent and did not use a condom.
The offence is accompanied by aggravating circumstances as envisaged by Section 185 bis of the Criminal Procedure and Evidence Act 67 of 1938 as amended.
This is in that Shongwe inflicted physical and lifetime mental trauma on the victim. The minor is aged 12 years making her incapable of consenting to sexual intercourse.Â

Lastly, when allegedly committing the offence, Shongwe did not use protection, in the process putting the victim at risk of contracting sexually transmitted diseases and HIV.
Shongwe made his first court appearance at the Pigg’s Peak Magistrate Court before Magistrate Sibonelo Dlamini.
